· INTRODUCTION
KampMart is a Campus based online marketplace for all Universities in Ghana. Our services include; advertisements of products, we give customers the opportunity to buy and also sell products, and we also offer students the chance to earn passive income through our affiliate marketing program.
By using our marketplace, you accept our terms and conditions in full.
If you use our marketplace in the course of a business or other organizational project, then by so doing, you:
· Confirm that you have accepted all our terms and conditions and are ready to accept any errors of your own doing.
· Also confirm to do business directly with us and with no third party without our consent.
· REGISTRATION AND ACCOUNT
1. You may not register with our marketplace if you are under 16 years of age.
2. You may register your account with us by visiting our website and filling in the necessary information, which includes your hostel, room number, etc. (if you are a student business owner or just a student customer).
3. You represent and warrant that all information provided in the registration form is complete and accurate.
4. Your account should be exclusively used by you and you shall not transfer your account details with any third party.
5. You are required to keep your password and other personal details confidential, and we promise to do same with any information you provide.
· VENDOR AGREEMENT
For our users to have the best experience, we implore you to adhere to the following list of rules when handling your store.- If your products can’t be made available to us within 24 hours, kindly indicate that in the description section of that particular product(s) together with an accurate description of the products themselves.
- Do your best to keep the prices up to date on your stores.
- In line with our mission to encourage student entrepreneurship, KampMart will help you sell your first two products, absolutely free of charge after which we’d take a commission based on the category of your item as indicated on the page following this link: www.kampmart.com/commissions/
- Two product flyers per store will be created and shared on our social media platforms free of charge by our marketing team, “KampMart Hypes”.
- Finally, KampMart reserves the right to take down any content uploaded by a vendor should we find it to be in violation of our “Rules about your content”, two sections below.
· PAYMENTS
1. You should always make payments directly to us whenever you buy from our website.
2. Payment methods include: Mobile Money, bank payments and cash on delivery.
· Rules about your content
1. In our terms and conditions, “your content” refers to: – All materials and works (including files, graphics, images, audio, video and audio-visual material, scripts and software) that you submit to our marketplace for storage or publication – All communications on the market place, including product reviews, feedback and comments
2. Your content and the use of your content in accordance with these terms and conditions must be accurate and truthful
3. Your content must be appropriate and civil and must accord with generally accepted standards of etiquette and behavior on the internet. It must not: – Be offensive, indecent, pornographic or sexually explicit – Be in breach of racial or religious hatred or discriminative – Cause annoyance or inconvenience to any person – Depict violence in any form – Constitute spam -Be fraudulent, abusive, harassing, hateful or discriminatory
4. You must not interfere with a transaction by: (i) Contacting a user to sell or buy an item outside the marketplace (ii) Contacting a user with the intent of collecting any payment (iii) Communicating with a user involved in an active or completed transaction to warn them from a particular buyer or seller or item
5. We may review your content and we reserve the right to take down any content in our discretion 6. You acknowledge that all users of the marketplace are fully responsible for interactions with other users. You must not send them personal information but exercise caution and good judgement in your communication with users.
7. Your content must not be illegal or unlawful nor must it infringe any person’s legal rights.
8. If you learn of any unlawful material or activity on our marketplace, or any activity that breaches these terms and conditions, you may inform us by contacting us.
· Our rights to use your content
1. You grant us a free license to use, reproduce, store, adapt, publish and translate and distribute your content across our marketing channels and any existing or future media
2. Without prejudice to our other rights under these terms and conditions, if you breach our rules in any way, or if we suspect reasonably that you have breached our rules on content, we may delete or edit any or all of your content
· Use of website and mobile applications
1. In this section, “marketplace” and “website” shall be used interchangeably to refer to KampMart’s websites and mobile applications
2. You may only use our website for your own personal and business purposes in respect to selling or purchasing products on the marketplace
3. We reserve the right to suspend or restrict access to our website. We may, for example, suspend access to the website during server maintenance or when we update the website.
4. Except as expressly permitted by these terms and conditions, you must not edit or otherwise modify any material on our website
· Copyright and trademarks
1. KampMart’s logos and our other registered and unregistered trademarks are trademarks belonging to us, we give no permission for the use of these trademarks or logos and such use may constitute an infringement of our rights
2. The third party registered and unregistered trademarks or service marks on our website are the property of their respective owners and we do not endorse and are not affiliated to any of the holders.
· Data Privacy
1. Buyers agree to the processing of their personal data in accordance with the terms of KampMart’s privacy and cookie notice
2. Sellers shall be directly responsible to buyers for any misuse of their personal data and KampMart shall bear no liability to buyers in respect to misuse by sellers of their personal data
3. KampMart shall process all personal data obtained through the marketplace and related service in accordance with terms of our privacy and cookie Notice and Privacy policy.
· Entire agreement
- Kampmart codes, policies and guidelines, general terms and conditions form our entire agreement with the sellers and Kampmart management in relation with your use of our marketplace. This agreement is thereby superior to all previous agreements in this respect.
· Hierarchy
- Should there be any conflict in our general terms and conditions, the seller terms and conditions, and the Kampmart codes, policies and guidelines, these terms and conditions, the seller terms and conditions and the Kampmart codes, policies and guidelines shall prevail in the order here stated.
· Variation
- Our terms and conditions, policies, guidelines, Kampmart codes as well as seller terms and conditions may be revised from time to time.
- These revised general terms and conditions shall apply from the date of publication of the changes on the marketplace.
· Assignment
1. You hereby agree that we may assign, transfer, sub-contract or otherwise deal with our rights and or obligations under these general terms and conditions.
2. You may not without our prior written consent assign, transfer, sub-contract or otherwise deal with any of your rights and or obligations under the general terms and conditions.
· Law and jurisdiction
- These general terms and conditions shall be governed by and construed in accordance with the laws of our constitution here in Ghana, in case any problems or misunderstandings can’t be handled by the administration of KampMart.
